1. Company, Contact
1.1 The online store operated on the Internet at the address www.nowandwow.ro is owned by SC Mint & Stripes SRL, with headquarters in Bucharest, Strada Călifarului, no. 5, Sector 5, registered at the Commercial Registry of Bucharest under no. J40/18606/2023, having CUI: 48891928, hereinafter referred to as Now & Wow.
1.2 The customer can contact the entity that owns the store, as follows:

2. General Rules for using the Now & Wow online store
2.1 The online store can only be used by people who are at least 18 years old.
2.2 Any person under the age of 18 can use the online store only with the consent of their parents or legal guardian.
2.3 Anyone who registers and buys in the online store provides their personal data and agrees that it will be processed by Now & Wow under the conditions defined in the Privacy Policy.
2.4 To confirm the correctness of the data provided during the registration process in the online store, the Customer receives an e-mail with the request to confirm his data.
3. Placing the Order
3.1 Orders are accepted through www.nowandwow.ro.
3.2 Products in the online store are specifically labeled. The website includes information about the characteristics of the products, their prices, the materials from which they are made.
3.3 When ordering a product, the Customer selects it in a manner specific to that product, determining in particular its size, color and, if necessary, providing other specific information as well as the quantity of products ordered.
4. How to buy in the online store – detailed guide
4.1 After selecting the desired product, the Customer must select the "Add to cart" option.
4.2 The product is automatically added to the "Shopping Cart", whose icon is visible on the navigation bar at the top right of the page. The Customer can always check the Shopping Cart by clicking on the "Your Cart" icon, which opens a separate window showing all the Products selected by the Customer.
4.3 By selecting the "Order" option, a page will open where the Customer will have to enter all the data to complete the transaction and deliver the products.
4.4 After logging into the online store, the Customer gains access to additional options in his panel, respectively: order history, the possibility to see the status of the most recent orders, the possibility to save the delivery address, the possibility to receive the latest information about to the products in the store.
4.5 When selecting the delivery method (with delivery to a specified address or from the physical Now & Wow store) and entering all the necessary details (including billing details if necessary), the payment method must also be chosen.
4.6 The customer can choose online payment (card payment) or cash payment on delivery.
4.7 Completion of the Order is done by clicking on the "Order and Pay" icon.
4.8 At any stage of placing the order, until the payment is made, the Customer can cancel an Order by interrupting the process and leaving the website. An order whose placement has not been completed will not be processed and will not create any obligations for the owner of the online store
4.9 Immediately after completing the order, the Customer will receive an e-mail/SMS confirming the order, to the address or phone number specified in the registration details. The email will include an individual order number that can be used, for example, to check the status of the order. The confirmation will include a summary of the Products, the price and payment method chosen, as well as the place, method and cost of delivery. Until the confirmation of the Order, the owner of the online store has no obligation towards the Customer to deliver the products.
4.10 Now & Wow may contact the Customer, either at the e-mail address or at the telephone number indicated, in order to clarify any doubts, to confirm the completion of the order or regarding any problem related to the processing of the order.
5. Prices
5.1 The prices in the online store, set in lei, are gross prices, including VAT.
5.2 The price of the product is increased by the delivery fees, highlighted separately, which depend on the method chosen for delivery and the payment method.
5.3 The price shown in the completed and placed order, as subsequently confirmed by the Order confirmation email, is the final price, binding on both Now & Wow and the Customer. The price shown in the completed, placed and confirmed order will not change, regardless of whether after that time Now & Wow changes the price of those Products or carries out certain promotional campaigns, special offers, soldering campaigns, which also include the Products.
5.4 Now & Wow reserves the right to change the price of existing products in the online store, launch new products, launch and cancel special offers on the store website or modify them, in accordance with the provisions of the Civil Code and other applicable laws .
6. Prices
6.1 Not all products offered in the online store are in stock.
6.1 Although the owner of the store permanently ensures that all products on the website, marked as such, are available, there may be exceptional situations (for example, in the case of simultaneous orders; in the case of technical failures occurring in the administration of the online store, etc.) in that a product is still unavailable so that the order cannot be accepted. In such a case, the Customer will be informed that the order could not be processed.
6.1 The product sheet includes full information on the size range – unavailable sizes are also listed but are clearly marked in a different color to that used for the available sizes. A product in an unavailable size cannot be added to the cart but can be added to the wish list.
7. Inability to process an order
7.1 If a product is not available in stock or the order cannot be processed for any other reason, the Customer will be notified by email or telephone of any processing issues
8. Delivery
8.1 The delivery of the Products ordered on this website will be carried out exclusively on the territory of Romania.
8.2 If the Customer chooses to pay in cash on delivery, processing of the order begins immediately after placement. If the Customer uses an online card payment method, the processing of the order begins after the crediting of the Now & Wow account (through the payment processor STRIPE) with 100% of the amount due for the order has been confirmed - this is the moment from which begins to run the term of delivery of the products to the Customer.
8.3 After the Customer has received the e-mail/SMS confirmation of the order, it will be delivered by us to the Courier and will be delivered to you by the Courier within an estimated period of no more than 2-7 working days from the confirmation of the order or when the Now & WOW account is credited with 100% of the order value in the case of online payments. The delivery time may be longer during sales periods or special campaigns. Business days are Monday to Friday, excluding public holidays.
When we deliver the Order to the Courier, you will receive a notification to this effect by e-mail or sms to the address and phone number provided. If, for whatever reason, the delivery deadline shown above cannot be met, you will be contacted by e-mail and informed about the actual delivery deadline.
For delivery you will be contacted in advance by the Courier, to whom you consent to provide your contact details for this purpose. Upon receipt of the Order you will present a valid ID and sign the AWB/Receipt Receipt.
If the package fails to be delivered after two attempts, the package will be returned to us and you will bear the costs and consequences of the return.
8.4 Delivery will be made via the Courier chosen at its discretion by Now & Wow.
8.5 Delivery charges are those mentioned in the special column at the time of completing and placing the Order, as confirmed later by the confirmation email. By completing and placing your Order you agree to pay these fees along with the Price of the Products. The delivery fee is applied for each parcel separately.
9. Billing and Payment
Based on the data provided when registering the Account, the owner of the online store will issue the Customer the invoice in electronic format and send it to the Customer to the e-mail address provided by him. The customer declares that he understands and expressly accepts such an invoicing method.
Payment can be made exclusively in the ways indicated in the ordering procedure, respectively:
9.1 In cash, upon delivery of the parcel. Payment is made to the Courier representative upon receipt of the package. It is recommended (but not required) to have the exact amount of cash.
9.2 Payment by card: The Customer must have a card that allows him to make online payments (the Customer must check with the bank issuing the card to what extent it meets these requirements). Payment by card is made through the online payment processor SHOPIFY. The following card types are accepted: Visa, Visa Electron, Mastercard, American Express. The payment operation is carried out between the Customer and the operator of the Customer's card.
Your card/account will only be charged once you have completed and placed your order. For your safety, all transactions are encrypted. Once the card transaction is approved, the payment amount is immediately blocked on the card/account and will be debited from your account when the seller sends you the order confirmation by e-mail. If, for any reason, the card transaction is not completed, your order is automatically canceled and the store owner has no further obligations to you. In this case, you will have to repeat the order procedure and provide a valid means of payment, among those accepted, shown in the order procedure.
In all cases where payment is made online, bank fees of any kind (eg transfer, currency exchange, etc.) are your responsibility and are not included in the Price/delivery charges. For information related to these fees, please contact the bank issuing the payment instrument/banking service provider in advance.
9.3 Please beware of phishing emails! Please note:
The owner of the online store will never notify you that he has changed the account for making payments and that a traditional transfer is required.
Now & Wow will never ask you to provide bank details, your card details or similar information by email or phone, nor will it contact you by phone or send you an email pointing you to another account payment bank or ask you to pay by money order or other traditional payment method. In the event that you receive such a request - you must not make the payment or respond to the e-mail but forward it, unchanged, to Now & Wow at contact@nowandwow.ro.
Information about making a payment will be requested by now & Wow only exceptionally as a result of a request addressed to us by you or when problems arise with an order placed by you. When we will request personal data personally by e-mail, we will always ask you to contact us by phone before provision or write to us, using the coordinates indicated in the Contact section.
If you receive a message that (apparently) requests specific personal data from us via a link, do not respond, do not follow the request, do not click on the link and immediately delete the email as it is a possible phishing email aimed at identity theft and/or infecting your computer with a virus/other cyber attack.
10. Time of closing of sale. Transfer of Property and Risks
10.1 The information available on the website www.nowandwow.ro does not constitute an offer within the meaning of the Civil Code, does not constitute a pre-contract or other commitment of Now & Wow towards the Client.
The sales contract is considered concluded only when the Customer receives the Order confirmation by e-mail from Now & Wow.
10.2 The transfer of ownership and risk of the Products occurs upon delivery of the package containing the Products, subject to full payment of the Price and delivery charges
11 Warranties
11.1 For the Products delivered, the Seller grants a guarantee under the law, the Products being accompanied by appropriate certificates in this regard.
12 The Customer's right to withdraw from the Contract. Return of Products. Return of Price and delivery charges.
12.1 The Customer may withdraw from the Contract, by unilateral termination, within a period of 14 working days, without having to cite any reason.
12.2 The right to withdraw from the contract expires within 14 days from the day of delivery (the day the parcel is received by the Customer or by a third party designated by the Customer and other than the carrier, as stated on the AWB/ receipt issued by Courier). The date of delivery of the parcel and the day when the deadline is met, enter into the calculation of the 14-day deadline
12.3 If he decides to withdraw from the Contract, the Customer is obliged to notify Now & Wow, by one of the following methods:

12.4 To be sure of terminating the contract within the term, it is sufficient for the Customer to send the notice of termination before the expiry of the term.
12.5 In the event of termination/withdrawal from the Contract, within no more than 7 (seven) days from the date of return of the Products and their accessories, in appropriate condition, according to those shown in these Terms and Conditions, Now & Wow will return without undue delay to the Customer their price as collected, excluding the payment of the delivery fee paid by the Customer to the Courier for the delivery of the Products or for the return of the Products.
12.6 The refund of the Price will be made in the same way in which these amounts were received in the original transaction, unless the Customer agrees otherwise and of payments received in cash on delivery, which will always be refunded to the Customer by bank transfer, to the account which the Customer is required to mention in the form/email/message. In all cases, the Customer will not bear any costs related to the refund.
12.7 Now & Wow may delay the refund until it receives the returned product or until the Customer provides proof that it has returned the product in proper condition, whichever occurs first.
12.8 In the case of withdrawal/denunciation, made with the fulfillment of the time and form requirements shown above, the Customer is obliged to return the Products in the appropriate condition in which they were received, unmodified, unworn (with the exception of testing), clean (but without have been cleaned/washed), unstained, unscratched and in all cases undamaged, with the labels intact, in the packaging in which they were received, within no more than 14 (fourteen) days from the announcement of the withdrawal decision (the day of the announcement of the withdrawal and the day completion of the term, entering into its calculation).
12.9 Products can be returned at the Customer's choice at his cost through a courier chosen by him or through the Courier chosen by Now & Wow.
12.10 The customer can also return the products in the Now & Wow physical store (located at the Bucharest address, Pătrascu Vodă street, no. 2, sector 3) without applying any return costs/taxes.
12.11 Where sets of Products have been delivered, the whole set must be returned as delivered. If a product was also received as a gift, it must also be returned. Any Product must be returned with all its accessories, which must be in proper condition, just like the Product.
12.12 If the Products are not returned in proper condition, as shown above, the Customer will bear their depreciation, reducing accordingly the amount to be returned to the Customer by the Seller. The Customer is responsible for any diminished value of the Products resulting from their use in a manner other than necessary to establish their nature, characteristics and function.
For Products returned to the Now & Wow store, their condition is checked at the time of return and communicated to the Customer on the spot. Regarding the condition of the Products returned in the other accepted return methods, mentioned above, the examination of their condition, to see to what extent they are compliant, will be carried out by the Seller within no more than 7 (seven) days from receipt, the Customer being informed within this term by e-mail/phone call/message in case of non-conformities that lead to the reduction of the amount to be reimbursed. The customer expresses his agreement regarding this procedure.
13. Complaints about the conformity of the Products
13.1 The products that are sold through the online store are new products that do not have defects. If the Products are nevertheless defective, Now & Wow will be responsible for them.
The Customer is asked to pay attention to the colors of the Products and to consider that, due to the settings of his computer/electronic device, certain actual colors of the delivered Products may differ from what the Customer's computer/electronic device displayed at the time of placing the Order. These differences cannot be considered non-conformities.
13.2 In the event that the Products show defects, detected within no more than 2 working days from delivery or intervened during the warranty period, established according to Romanian law, the Customer can address a complaint sent by e-mail/phone call/message at the address and telephone numbers shown in the Contact Section and to return the Products, according to the procedure shown in these Terms and Conditions.
13.3 Complaints must specify their causes and the information necessary to identify the order. For complaints, the customer can use the contact form in the Contact section provided on the website or the e-mail address consta@nowandwow.ro, and the products must be returned to the Now & Wow store address, Bucharest, strada Pătrșcu Vodă, no. 2, sector 3.
13.4 Now & Wow provides Customers with the opportunity to make a complaint and return defective products by courier at Now & Wow's expense. For this, the Customer must send an e-mail to the address contact@nowandwow.ro, fill in the electronic contact form in the Contact section, with details about the address, specifying the place from where the courier must pick up the shipment containing the products mentioned in the complaint.
13.5 Now & Wow will review the complaint within 7 days and inform the Customer of the outcome.
13.6 If the Customer's complaint is found to be well-founded, the defective Products will be replaced or, in case of impossibility of replacement, the Customer will be refunded the Price together with the delivery charges, within 7 (fourteen days) from settlement of the complaint.
13.7 If the claim is deemed unfounded, the Products will be returned to the Customer, at his cost, without any further obligation on the part of Now & Wow.
13.8 About the resolution of the complaint and the solution adopted according to the above, the Customer will also be informed by e-mail/phone call/message, to the address or phone number provided during user registration.
13.9 In the event of a refund by Now & Wow of the Price and delivery charges, the provisions of the relevant section of these Terms and Conditions shall apply accordingly.
14. Cancellation of an order
14.1 The customer can cancel an order.
14.2 To cancel an order, please contact us by e-mail/phone call/message in max. 1 hour after placing the order.
15. Miscellaneous
If, for technical reasons, the invoice was not received by e-mail, the Customer can request a copy to be sent in electronic format. Now & Wow will not be responsible for incorrect data provided by the Customer.
15.1 Processing of personal data
The Client's consent to the processing of personal data is voluntary, but the refusal to provide consent to the processing of personal data makes it impossible to register and buy from the online store. Any information on the processing of personal data can be found in the Privacy Policy section.
15.2 Processing of personal data for marketing purposes
The customer may consent to the processing of personal data and the transfer to a third party for the purpose of receiving commercial information from Now & Wow, for example regarding special offers. Any information about this is available HERE.
16. Liability
Liability of Now & Wow – in the event of willful or grossly negligent breach of the Terms and Conditions and/or the Contract: Now & Wow as the seller and owner of the online store will be liable for losses that are a direct and reasonably foreseeable consequence , of this violation.
In any case (excluding liability for damage to the life and/or bodily integrity of a person) the maximum liability to the Customer for any loss or damage arising in connection with an Order is limited to the total price of that Order.
Now & Wow is not responsible for the infection of a User's/Client's computer with computer viruses, for cyber-attacks of any kind, for the loss of the User's/Client's data on its devices or for damage to any hardware or software belonging to it.
Also, Now & Wow is not responsible for phishing e-mails or partner links that may appear on the website from time to time.
Responsibility of the User/Client: The User/Client is responsible for maintaining the confidentiality of his/her Account data (user/e-mail and password), for managing access to the Account and for the activity carried out through the Account, as well as for browsing the websites and links the partners. Also, the User/Customer bears sole responsibility for the truth/accuracy/integrity of any and all data provided to the store owner and for any damage caused to the store owner by non-compliance with these Terms and Conditions and/or the Agreement.
17. Intellectual Property
All website content, including but not limited to logos, graphics, trademarks, static/dynamic images, text and/or multimedia content, is the exclusive property of Now & Wow.
The User/Client is not allowed to copy, reproduce, distribute, publish, transfer, modify, alter, use, link, display, include any element of the website in any material of the User/Client or a third party, in other purpose other than to conclude / execute a Contract for Products and to find out about the Products sold on the website, without Noe & Wow's prior written agreement in this regard.
If the User/Client transmits/transfers to the owner of the online store any information or content (including logos, graphic representations, commercial symbols, static/dynamic images, text and/or multimedia content) this will not generate any obligation for Now & Wow, unless there is a prior written agreement of the parties to this effect.
By accessing these Terms and Conditions, the User/Client understands and accepts that any use of the website and its content for purposes other than those expressly permitted under the Terms and Conditions/Contract is expressly prohibited.
18. Force majeure. The fortuitous case
Neither party shall be liable for failure to perform its obligations under the Contract or set out in these Terms and Conditions, if such failure to perform on time and/or properly is due in whole or in part to a force majeure event or a fortuitous event. Force majeure is the external, unpredictable, absolutely invincible and unavoidable event. A fortuitous event is an event that cannot be foreseen or prevented.
If, within 30 (thirty) days from the date of production, the force majeure event or fortuitous event does not cease, each party will have the right to notify the other party of the full termination of the Contract without any of them being able to claim the other damages.
19. Applicable Law. Jurisdiction
These Terms and Conditions, as well as the Contract, are subject to the provisions of Romanian law. In case of disputes, they will be resolved by the competent court, the User/Client expressing his agreement regarding this choice of jurisdiction.
19. Final Provisions
If, for any reason, any provision of these Terms and Conditions is found to be void, unenforceable or invalid, it will be replaced by a valid provision as close as possible in meaning to the original provision.
The invalidity/ineffectiveness of a clause/provision of these Terms and Conditions and/or the Contract will not affect the validity/applicability of the other clauses/provisions, which will continue to apply unchanged.
